In Antonio Rodríguez Abogados / Correduría Pública 42 de Jalisco, S.C. hereinafter (“AR Abogados”), your privacy and trust is very important. We have the obligation to comply with administrative, legal and security measures to protect your personal data, in compliance with the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals published in the Federal Official Gazette on July 5, 2010 and its Regulations published in the Federal Official Gazette on December 21, 2011 (hereinafter referred jointly as “the Law”), for which we hereby inform you of the following:

1. Identity of the Individual Responsible for the Protection of your Personal Data.
Antonio Rodríguez Abogados / Correduría Pública 42 de Jalisco, S.C. hereinafter (“AR Abogados”), with address located at Avenida Cuauhtémoc number 850, Colonia Ciudad del Sol, Zip Code 45050, Zapopan, Jalisco, México is responsible for the processing of personal data provided to it by the individuals to whom such data corresponds (hereinafter the Data Subject), as well as for the use and protection of such data. In accordance with the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals (hereinafter the “Law”). “AR Abogados” has all the appropriate physical, technical and administrative security measures to protect your personal data and prevent unauthorized third parties from accessing them.

2. Personal Data.
The processing of the personal data of the Data Subject that have been provided to “AR Abogados” under any way or circumstance, may be executed in accordance with the present terms and conditions, so from this moment on, it is understood that the Data Subject grants his/her consent for such processing. Understanding Personal Data and Sensitive Personal Data as follows:

Personal Data: Any information related to an individual identified or identifiable, including but not limited to: (i) full name, (ii) age or date of birth, (iii) place of birth, (iv) activity, profession, occupation, or trade, (v) home address, (vi) telephone number, (vii) e-mail, among others.

Sensitive Personal Data: That personal data that affects the most intimate sphere of its owner, or whose improper use may give place to discrimination or involve a serious risk for the same. Specifically, it is considered as Sensitive Personal Data such data that may reveal aspects such as racial or ethnic origin, present and future health status, genetic information, religious, philosophical, and moral beliefs, trade union membership, political opinions, sexual preference, among others.

3. Purpose of Data Processing.
The Personal Data and/or Sensitive Personal Data information, which is collected by “AR Abogados” directly from the Data Subject with his/her full consent, will be used, including but not limited, as described below:

Of the Users of the Services: From clients or users of the services offered through the platforms of “AR Abogados” we will use the data you provide to us in order to offer and render our legal services, including but not limited to the following areas: corporate law, real estate law, appraisals, family and inheritance law, contracts, foreign investment, financial law, official certifications, intellectual property, money laundering prevention, litigation, commercial arbitration and dispute resolution, among others.

The purpose of obtaining Personal Data and/or Sensitive Personal Data is to provide our services in the correct way, always searching for the benefit of our customers.

For the aforementioned purposes, we need to obtain the following personal data: (i) full name, (ii) personal and tax address, (iii) e-mail, (iv) telephone number, (v) Federal Tax Identification Code (RFC), (vi) Sole Population Registry Code (CURP), (vii) place of birth and nationality, (viii) marital status and, if applicable, marriage property regime, (ix) signature, (x) voter’s credential ID and/or passport data, (xi) immigration status, (xii) tax and corporate information, (xiii) occupation, work or trade, among others.

It is the responsibility of the Data Subject to guarantee that the Data provided to “AR Abogados” is correct and complete and the Data Subject is responsible for communicating to “AR Abogados” any changes thereto in order to comply with the obligation to keep the information updated.

The temporality of the management of the Data Subject Personal Data will depend on the legal relationship held with “AR Abogados”, as well as the obligations required by the current legislation and the competent authorities. In all cases the information will be kept only for a reasonable period.

4. Rights to limit the use or disclosure of Personal Data.
The information delivered to “AR Abogados” will be duly safeguarded, preserved, and protected with the appropriate administrative, technical, and physical security measures in order to prevent its loss, misuse, alteration, unauthorized access and theft. Only those persons authorized by “AR Abogados” will have access to the information, whether they are employees, services providers, or business partners, who have assumed the commitment to keep the information under a strict order of confidentiality and security; for this purpose, employees have been trained in its handling, signing a confidentiality agreement with “AR Abogados”, and suppliers and business partners have signed in the agreements and contracts a clause where the confidentiality of the information is agreed.

5. Data Transfer.
In the event that the personal data safeguarded by “AR Abogados” is required by an authority of any kind, either by legal process, to answer any claim or legal action in connection with the fulfillment of the legal relationship between the Data Subject and “AR Abogados”, or to protect the rights of “AR Abogados” or its clients and the public; this data will be made available to the authority in strict compliance with the Law.

This transfer will be made taking reasonable measures, necessary and available to “AR Abogados” to protect personal data against damage, loss, alteration, destruction or unauthorized use, access, or processing. The access to this information is limited to the individuals who must have knowledge of the same in order to comply with the purpose of their job.

Your personal data may be transferred and processed inside and outside the country, by individuals other than this company exclusively with advertising services providers for the purpose that such companies can render any service to “AR Abogados. In that regards, your information may be shared with foreign Mexican third parties and members of our group, to provide services necessary for its proper operation. If you do not express your opposition for your personal data to be transferred, it will be understood that you have given your consent to do so.

To express your opposition, please send an e-mail to arabogados@arabogados.mx indicating that you do not want your personal data to be transferred.

In case of transfer, we inform you that “AR Abogados” will take the necessary measures to ensure that the individuals who receive them comply with the privacy policies of “AR Abogados” and the purposes contained in this privacy notice.

6. Methods to exercise your ARCO Rights.
If you do not agree with the use of your data for any of the denominated “unnecessary purposes” you will have the right to request the access, rectification, cancellation or opposition of your data, through a written request addressed to the following address: Avenida Cuauhtémoc 850, Colonia Ciudad del Sol, C.P. 45050, Zapopan, Jalisco, Mexico, from 9:00 a.m. to 3:00 p.m., on business days addressed to the Department of Personal Data Protection, or by request made to our Customer Service System telephone numbers (33) 3884 1430, or by e-mail to arabogados@arabogados.mx if you wish to limit the use or disclosure of your personal data, you may express your refusal or limitation to such treatment or disclosure within a period of 5 business days from the date you have had knowledge of this privacy notice as follows:

a) By written communication addressed to the Department of Personal Data Protection of “AR Abogados” and may be delivered to the address Avenida Cuauhtémoc 850, Colonia Ciudad del Sol, C.P. 45050, Zapopan, Jalisco, Mexico or sent to the following e-mail arabogados@arabogados.mx.
b) Indicate your full name and address or other way to communicate the answer to your request.
c) Enclose the documentation that proves your identity or, if applicable, the legal representation of the data subject, the elements and/or documents that facilitate the location of the personal data.
d) Specify the purposes you wish to eliminate or the limitations you wish to establish.

The above, in the understanding that in any case your rights of revocation and opposition will be safe. Upon receipt of your request, we will respond either by email or in writing according to the information you have indicated in your request, within 20 business days from receipt of your request. The above in the understanding that we may require additional information as per the terms provided in the Law and its Regulations, in which case the response period will be counted from the time you provide us with the additional information/documentation.

The refusal to use your personal data for unnecessary purposes may not be a reason for us to deny the services and products you request or contract with us.

7. Consent.
With this Privacy Notice, the Data Subject consents to the use of his/her personal information and is duly informed of the data collected from him/her and for what purposes, accepting the terms contained herein, which were prepared in compliance with the Federal Law for the Protection of Personal Data in Possession of Individuals.

8. Amendments to the Privacy Notice
“AR Abogados” reserves the right to make changes or updates to this privacy notice at any time, to address legislative developments and new legal requirements, internal policies on privacy or new requirements for the rendering or offering of our services or products. These amendments will be available to the public through our website: www.arabogados.mx

9. Use of cookies and web beacons.
We inform you that we use cookies and web beacons for the purposes of this document, Cookies will be understood as the data file that is stored on the hard drive of the computer equipment or electronic communications device of a user when browsing a specific Internet site, which allows the exchange of status information between the site and the user’s browser. Meanwhile, web beacons are images inserted in an Internet page or email, which can be used to monitor the behavior of a visitor, as storing information about the user’s IP address, duration of interaction time on that page and the type of browser used, among others.
